Recent Local Government Decisions
- Southwestern Bell Tel., LP v. City of Houston (5th Cir. 2008). Section 253(a) of the Federal Telecommunications Act is not for the purpose of enumerating the rights of telecommunications companies, nor does it preempt the right of a city to recover right-of-way relocation costs. (Please bold and italicize the case names on these 3 entries)
- DesPain v. City of Collinsville (5th Dist., May 2008). Plaintiff was entitled to listen to originals of audiotapes under FOIA.
- Columbia Crossing, LLC v. City of Columbia (S.D. Ill., 2008). City Agreement with a developer was void and unenforceable because the city lacked statutory authority. Voided a Master Development Agreement. City never made any of the statutorily-required findings to support the Agreement.
